OIYS Video Sweepstakes Official Rules

Participation in the VIDEO SWEEPSTAKES (the “Sweepstakes”) constitutes your agreement to be bound by these Official Rules (“Official Rules”) and Sponsor’s Terms of Use and Privacy Policy.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN THE SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR LIKELIHOOD OF WINNING.

ALL APPLICABLE LAWS AND REGULATIONS APPLY. PARTICIPATION IN THE SWEEPSTAKES IS VOID WHERE PROHIBITED.

Sweepstakes Period: The Sweepstakes begins at 12:00:00 AM Pacific Time on [12/21/22], and ends at 11:59:59 PM Pacific Time on [3/20/23] (the “Sweepstakes Period”).

Sponsor: Leaf Group Ltd. is the sponsor of the Sweepstakes (the “Sponsor”). The Sponsor’s address is 1655 26th Street, Santa Monica, California 90404.

Eligibility: To participate in the Sweepstakes, you must be a legal U.S. resident and eighteen (18) years of age or older. Employees, officers, and directors of the Sponsor and its subsidiaries/affiliates, OnlyInYourState, Hunker, Well+Good, Livestrong, and Society6 (collectively, the “Sweepstakes Partners”), and their immediate family members (spouse, and parents, children and siblings and their respective spouses, regardless of where they reside) and household members, where or not related, are not eligible to participate in the Sweepstakes.

How to Enter: You may submit Sweepstakes entries during the Sweepstakes Period by [completing and submitting the Sweepstakes Google Form on our site (each an “Entry”).] You may enter an unlimited number of unique videos that meet the submission guidelines. The sole determinant of time for the purposes of receipt of a valid Entry in a Sweepstakes will be determined by Sponsor. Proof of submission (screen captures, etc.) does not constitute proof of entry. All Entries become property of the Sponsor and will not be returned.

Requirements of Entries: Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:

is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
is obscene or offensive; endorses any form of hate or hate group;
appears to duplicate any other submitted Entries;
defames, misrepresents or contains disparaging remarks about other people or companies;
contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
contains look-alikes of celebrities or other public or private figures, living or dead;
communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
violates any law.

If the Entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that entrant and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Sweepstakes and to its use as otherwise set forth herein.

By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason, including if it determines your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content.

Your Representations to the Sponsor: You represent and warrant that: (a) the information and documents (including all text, photographs, graphics, and other works) you have submitted or will submit to the Sponsor in connection with the Sweepstakes are true, correct, and complete in all material respects and not misleading; (b) footage was not filmed on private property, (c) you have permission from any person who appears in the Entry and can provide such permission in a form acceptable to Sponsor, and (d) you have never been arrested, indicted, convicted or pled no contest to a felony or a crime involving moral turpitude. You represent and warrant that any text, photograph, graphics, videos, images, likenesses, personal information, and other works of authorship that you submit in your Sweepstakes entry or entries shall comply with the ONLYINYOURSTATE.com Terms of Use which can be found online at: https://www.onlyinyourstate.com/terms-of-use/

Grant of Rights To Entry: By entering this Sweepstakes, and to the extent allowed by law, entrants grant Sponsor and the Sweepstakes Partners and each of their affiliates, licensees, promotional partners, advertising and promotion agencies, and third-party marketing entities (collectively, “Affiliated Entities”) the absolute right and permission to use their name, biographical data, photograph, voice, performance, and/or other likeness and/or prize information and to grant an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to Affiliated Entities to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, adapt, publish, distribute, exploit, and use the content of and elements embodied in the Entry, in whole or in part, in commerce and for advertising, promotional or other purposes, in any and all media, now or hereafter devised. worldwide, without limitation or compensation or notification to, or permission from, the entrant, who may be required to sign a release to that effect. Entrants waive and release Released Parties (as defined below) from any and all claims that entrants may now or hereafter have in any jurisdiction based on “moral rights” or unfair competition with respect to Sponsor’s or any Released Party’s exploitation of Entries without further notification or compensation to, or permission from, entrants of any kind, and agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties, on the grounds that any use of any Entry, or any derivative works, infringe, or violate any of entrant’s rights therein.

Participation in the Sweepstakes constitutes permission for the Affiliated Entities to use the winner’s name, likeness, city, state of residence, personal information and text, photographs, graphics, video, or other works of authorship submitted in their Entry to appear on the ONLYINYOURSTATE.com website, any ONLYINYOURSTATE.com affiliated Facebook Page or Group, any ONLYINYOURSTATE.com affiliated Instagram pages, any ONLYINYOURSTATE.com affiliated YouTube channels, any ONLYINYOURSTATE.com affiliated emails or newsletters, and elsewhere in all media for advertising, marketing and promotional purposes without compensation, unless otherwise prohibited by law.

Entrants hereby acknowledge and agree that the relationship between entrant and the Sponsor is not a confidential, fiduciary, or other special relationship, and that entrant’s decision to provide the Entry to the Sponsor for purposes of the Sweepstakes does not place the Sponsor in a position that is any different from the position held by members of the general public with regard to elements of the Entry, other than as set forth in these Official Rules. You understand and acknowledge that the Sponsor has wide access to ideas, photographs, videos, designs, and other literary and artistic materials, and that new ideas are constantly being submitted to it or being developed by its own employees. You also acknowledge that many ideas or videos may be competitive with, similar to, or identical to the Entry and/or each other in theme, idea, format, or other respects. Entrant acknowledges and agrees that he/she will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material that has or may come to Sponsor from other sources. Entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the entrant’s copyright in and to the submission.

Selection of Winner: Odds of Winning: [One (1)] potential winner (the “Potential Winner”) will be selected at random by Sponsor following the close of the Sweepstakes Period from the pool of eligible Entries received. Odds of winning a prize depend on the number of eligible Entries received. POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, AND MUST MEET ALL ELIGIBILITY REQUIREMENTS BEFORE AN ENTRANT WILL BE CONFIRMED AS A WINNER AND A PRIZE WILL BE AWARDED.

Winner Notification: Potential Winner will be notified via email within ten (10) business days following the expiration of the Sweepstakes Period and may be required to execute and return an Affidavit of Eligibility, Liability and, unless prohibited, Publicity Release. The Potential Winner will have seventy-two hours (72) hours from the initial message from the Sponsor to respond and claim their prize. If the Potential Winner does not respond within the seventy-two (72) hour period, or if they have not complied with these Official Rules or decline a prize for any reason, or fail to timely return all required documentation, then the Potential Winner will forfeit the prize and the Sponsor may, at its discretion, select an alternate winner from all remaining eligible Entries.

Prize: [$250 VISA eGift card]. Terms and conditions apply to use of eGift card. No substitution, transfer or cash equivalent of any prize is permitted by winner. If the prize (or portion thereof) is not reasonably available, the Sponsor may substitute the prize (or portion thereof) with one of comparable or greater value. All prizes awarded are subject to the restrictions and limitations noted in these Official Rules, on the prizes and/or included with the prizes and the winner must abide by all such limitations and restrictions. Winner agrees to accept the prize “as is” without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. The Sponsor has the right to resolve any concerns, questions, or complaints related to the prizes in its sole discretion. Winner is solely responsible for any and all federal, state and/or local taxes, fees, and any other costs in connection with receipt of the prize not specified herein as being provided. Limit one (1) prize per person. All prize details are at Sponsor’s sole discretion.

Publicity Grant: Participation in the Sweepstakes constitutes permission for the Sponsor and the Sweepstakes Partners and their respective designees to use the winner’s name, likeness, city, state of residence, personal information and text, photographs, graphics or other works of authorship submitted in their Sweepstakes entry to appear on the Sponsor’s and/or any Sweepstakes Partner’s website or social media accounts and elsewhere, in any and all media, for advertising, marketing and promotional purposes, worldwide in perpetuity, without compensation, notification or permission, unless otherwise prohibited by law.

Limitations of Liability: Entrants, by participating, agree to release, indemnity and hold harmless the Sponsor, Sweepstakes Partners, and all social media platforms on which the Sweepstakes is advertised, and their respective parents, and affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) against any liability for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of prize or participation in this Sweepstakes. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, emails, responses, mail, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer or other devise related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

Any and all disputes will be resolved in the appropriate courts in the County of Los Angeles, State of California, exclusively, and subject to the laws of the State of California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California.

Use of Data: By entering the Sweepstakes in accordance with the entry process described above, you will be registering to receive email communication from Sweepstakes Partners, and agree that your registration and any other information collected in connection with the Sweepstakes may be used by them. Winners List: To obtain a written identification of the winner(s), please send your request and a self-addressed stamped envelope to: OIYS Video Sweepstakes, Leaf Group, 1655 26th Street, Santa Monica, California 90404. Requests must be received within four (4) weeks of the end of the Sweepstakes Period.

THE SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, GOOGLE, FACEBOOK, INSTAGRAM, TWITTER, TIKTOK, SNAPCHAT OR ANY OTHER SOCIAL MEDIA PLATFORM.
